If you have a small amount, (1 oz) or less, your best bet is to demand a jury trial, defend yourself, don't hire an attorney who is gonna make a deal, and watch them drop it. If you go to a jury trial, chances are on your side, the jury will not find you guilty but it will cost the state a lot of money for a jury trial, you can then argue the medical part, (as NC sends 300 marijuana cigarettes for free for medicine to four people in the US) and end the nonsense with a jury trial. If we all demanded a jury trial and didn't hire lawyers, the people themselves would put an end to this nonsense.

Hi All....Yes..I am still alive... ;) Let me sum this up for you as far as what "they" can do and cannot do. They can do ANYTHING they want...They can bend,twist,manipulate and break any laws or rules they want to. Once they get their hands on you, you are their property and they treat you as they would a murderer or rapist. I was sitting at home bothering no one...they knocked on my door and told me to step outside...they arrested me for plants I had in my garden. They took me to jail even though I told them I could not lock up my house because of a broken door handle. I was treated like an animal in a cage. I was in jail for 11 days before they reduced my bail enough for my family to get me out. When I went home everything I had was stolen. I am talking about over $3,000 of my personal property was stolen.TV, X-Box, Guitar, Organ, antiques, even all my groceries. I filed a report and now 7 years later I have YET to hear back from anyone regarding my stolen property. So..unless you are related to law officials or rich you are subject to whatever they want to do with you. Everytime I hear someone say "they can't do that"...I just laugh :lol: And say " Oh YES they CAN". :whistle:
In this state anything over 10 pounds is trafficking...and if they find plants they weigh them GREEN with all stalks and sun leaves intact. Even though the NC law states that stems, roots and seeds are exempt. So to break it down one to four large plants can get you a felony trafficking charge :angry: if they weigh even one gram over 10 pounds GREEN weight. A plant is 65-75% WATER. 10 pounds of GREEN weight will dry out to be LESS than 4 lbs and if you remove all the stalks and sun leaves that takes it down to less than 2 pounds DRY weight. It doesn't take a scientist to KNOW this but they will still charge you with the GREEN weight of plants. Several other states will only charge you with DRY weight but NC is one a a very few states that uses GREEN weight in their charges.
I used to ponder the same question that was posted here...If I am a member of an organization like this one and I got arrested for trying to grow my own medicine would anyone be there to help me ? :huh: :unsure: I even asked the basic same thing many, many months ago in one of my post... and from the responses I got my final decision is NO...they would not... Everyone has to look out for themselves...No one is going to risk their own freedom to come to the "rescue" of a fellow member. I have watched the interaction of members here for a long time now. I have supported NCCPN and I did all I could for the cause back when HB-577 was first introduced. I have seen many members get dis-heartened and drop out and some members give up and say they are moving to a more cannabis friendly state. My own dissappointment was learning about "lobbyist". As long as there are lobbyist out there PAYING our representatives for their votes what chance do we have? :dry: My own humble opinion is that it all boils down to one thing... MONEY. I learned that politics is dis-honest and underhanded. I think a certain house and rules committee chairman proved that with his slander of Mr. Parks and his personal interests and investment into a brewery in his home county. His part in the nurses assoc. retracting their website statements on the usefulness of cannabis as medicine. :angry:
I guess I tend to ramble on and on in my posts and I sometimes VENT. As I along with so many others I am sure are so angry that 16+ other states can legally do what we cannot in NC. And watch weed wars and see how they did the dispensaries in Colarado. And see that Big Govt and Big Pharma are teaming up to control the MONEY that is to be made with this medicine as with any medicine.
I admire and support EVERYONE on this site who is fighting and doing what they can in this cause. It does help to know that we are not all alone in our beliefs and knowledge of the benefits of this PLANT. There are a lot of people who canot afford the high prices associated with the black market of cannabis. They cannot afford a $250.00 fine or risk being made into a criminal by the state. So they suffer in silence and do without a medicine that would make their quality of LIFE 10 times better. :( :( Thanks again to ALL who are fighting to end the suffering of so many NC citizens and Vets who would benefit greatly to have access to medical cannabis.

Well, I don't have much to say except...right on Farmer. Well at least there are a few of us that would stand against tyranny together. I lived for 2 years with legal access to Cannabis only to have it snatched away again in NC.

a friend who is terminally ill had a very small amount of cannabis growing in garden with veggies and herbs. one day everyone shows up to the party to ruin his life. they pulled up the cannabis and in the process trampled this veggies which he needs for this poor man to eat. handcuffed and locked up for 48hrs waiting on a judge to set bail. he gets bail, judge sets it lower than normal cause they don't want this aids patient in their jail. he hires a lawyer cause the charges just get stacked and stacked. this is common practice to scare the hell out of you into pleading guilty in exchange for dropping all the bogus stuff. he had no money, guns, scales, not selling or trading but gee wiz can you really be charged with having bat guano to support an illegal grow? how ridiculous. it was for the whole garden as was the tools etc. the lawyer takes $2500 just to take the case. He tells my friend get ready to spend $35K +++. eventually the feds decline to prosecute but leave the charges open just in case. the state charges him with 1 simple crime of possession which he pleads to that in exchange for everything else going away. gets a small fine/court cost/time served. so now he is out $3k and has a small criminal record. to a dying man things aren't so bad but..........2 years later the IRS decides he owes unpaid taxes on the plants and small amount of bud found in his house. Now he owes $170k. they slapped a lien on his already liened on house. his meds are $100k + per year which medicare pays most and he collects disability. ain't life grand.

Green, I can't tell you how sorry i am that noone came to help you. We should have come to your aide in at the very least visit you at the jail and have many many people from this site come and stand before the doors and scream at them. Maybe not literally, but, signs and posters, etc. Someone has to have the guts to stand up and tell them we are not going to take it any more. I wish I had know you were suffering like this, I would have some how made it there to help you in your time of need. This all makes me sicker than I am. I hope you are back on site and will give us another chance, we are a different group at this time than we were last year and have more fighters here at this present time. I guess timing is everything and unfortunately you suffered alone in your darkest hour. I am so sorry for that. I hope you are doing better and have gotten those nightmares out of your head by now and will give us another chance. Peace to you my friend. B

Salty, that is it in a nut shell!! They get into Government for the MONEY!!! this all sucks, Medicare/Medicaid will pay for Marinol with aproval @ $6plus a pill that sucks :angry: other people pick up the tab when if it were legal I could grow or get it at a store!, but ya cant grow Cannabis, ya have to get it from the Government in a gel-pill and it takes too long to work.
I'm on disability from my car accident and pills pills and more they will Rx and give, but Cannabis oh no, it is not legal, all my Dr.s don't mind it a bit, but it is still illegal!

Hello Again...Beccie...I want to clarify that my arrest and conviction were not recent, it was 6 years ago. I was on house arrest for 10 months and DRC for 11 months with weekly drug testing. Its all behind me now, but I can never grow my own medicine again with a record like that as I would be considered a repeat offender or what they call a habitual felon and be thrown in prison. :unsure: :blink: :whistle: Thanks again for the efforts and I am still in the fight if there is anything I can do.
