Hello Perry,

What do you recommend for us fellow Disabled Veterans, as far as purchasing Tax Stamps for Cannabis?

Do you pay taxes on your medicine?

Do you think it is a security risk?

Are any other members currently abiding by the law related to Tax Stamps?

Your input is really appreciated.

What is the nccpn going to do as far as helping members find medicine? Do we just have to take our chances of growing our own medicine? What about the folks that are unable to?

Does Rep. Alexander, or any of your other hight level contacts have any input on this issue?

Kind regards,

Naphtali,

According to the laws regarding tax stamps (I am paraphrasing),
.....You do not have to give your name to get your stamp(s).
.....I don't know of anyone who has paid the tax for their medicine so that will remain one of those grey area questions.
.....As far as a (personal) security risk, it is against the law for any employee of the state to disclose any information regarding the purchase of tax stamps for Unauthorized Substances (this is for cannabis and cocaine.) to Law Endforcement Officers. However if it is a part of an active investigation these items can be subpoenaed.
.....Since at this time cannabis is illegal in the state of North Carolina, the NCCPN does not help members or non-members find their medicine. If a member does find medicine for other members he/she does so on their own.

I am sure Perry will discuss this further, and I hope this helps you.

Cannabis tax per gram of material is $3.50/gram for leaf material and $.40/gram of stem material.

Hey Kevin I am not sure what calculator you used but 28 grams at $3.50 a gram comes to $98.00 actually if you add the .35 after the 28 to make it a true ounce 28.35 the amount would be $99.225

As far as more information the law says that:
- You DO NOT have to provide your name, address, SSN or other identifying information.

-The tax is payable 48 hours after obtaining the product. Once the tax is paid, (evident by the tax stamp affixed to the container holding the product) not other tax is required even if handled by another person.

- And, information obtained pursuant to the unauthorized substances tax law is confidential and may not be disclosed or, unless independently obtained, used in a criminal prosecution other than a prosecution for a violation of the unauthorized substances tax law. Revenue employees who divulge information regarding stamp purchasers to law enforcement shall be guilty of a Class 1 misdemeanor.

- Once you purchase the tax stamp you will NOT be in legal possession of an unauthorized substance, purchasing stamps only fulfills your civil unauthorized substance tax obligation. You will still be in violation of the criminal statues of North Carolina for possessing the drugs.

The following link will direct you to the laws regarding Unauthorized Substances and then some. The section that applies to the taxes is section 2D.
